1. Agreement to Terms

gammarecords.com is operated by Gamma Records, Inc., established in the Illinois, United States (“we,” “us,” or “our”).

By accessing or using our services, including our website at gammarecords and related applications (collectively, the “Service”), you agree to be bound by these Terms of Service (“Terms”).

If you do not agree to these Terms, you may not access or use the Service. We may update these Terms from time to time, and your continued use of the Service constitutes acceptance of any changes.

2. Eligibility

You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that:

You are at least 18 years of age
You have the legal capacity to enter into a binding agreement
You are not prohibited from using the Service under applicable laws
Your use will comply with these Terms and all applicable laws and regulations

3. Account Registration

When creating an account, you agree to:

Provide accurate, current, and complete information
Maintain and promptly update your account information
Keep your password secure and confidential
Accept responsibility for all activities under your account
Notify us immediately of any unauthorized use

4. Service Description

gammarecords provides a platform for record label, digital distribution, publishing, radio airplay submissions. The Service includes:

For Artists: Upload demos, review submissions, 
Submission Fees: Purchase submissions for label roster consideration, ($10.00 per each song review)
Submission Guarantee: Will review submission within 1 week. We only contact, feedback, reply to artist, if submission meets our industry quality standards.

5. User Content

You retain ownership of content you upload to the Service (“User Content”). By uploading User Content, you grant gammarecords a limited license to:

Store and process your content to provide the Service
Share your submissions with selected curators for radio airplay review

You represent and warrant that you own or have the necessary rights to all User Content you upload, and that your content does not infringe any third-party rights.

6. Prohibited Conduct

You agree not to:

Upload content you do not have rights to
Infringe on any intellectual property rights
Upload harmful, fraudulent, or illegal content
Harass, abuse, or harm other users
Attempt to circumvent any security measures
Use automated systems to access the Service without permission
Misrepresent your identity or affiliation
Violate any applicable laws or regulations

7. Payments

The Service uses a PayPal system for submissions:

• Submissions are purchased through PayPal.com, which acts as the merchant on the transaction, issues your invoice
• After 7 days of receiving submission (7 days review period from the date of purchase) – the payment is not refundable

8. Intellectual Property

The Service and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of gammarecords. 

9. Termination

We may terminate or suspend your account immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

10. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. WE DO NOT GUARANTEE ANY SPECIFIC OUTCOMES FROM USING THE SERVICE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GAMMARECORDS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

12. Governing Law

These Terms shall be governed by the laws of the Illinois state, US, without regard to conflict of law principles.
